Important Notice

These Terms of Service are a legal agreement between you and CodeBaker Bilisim Hizmetleri ve Ticaret Limited Sirketi ("CodeBaker", "we", "us" or "our"). They apply to the CodeBaker website, opt-in form, SMS/MMS communications, mobile applications and related services where these terms are shown.

By accessing or using the services, you confirm that you have read, understood and agree to these Terms of Service. If you use the services on behalf of another person or organization, you represent that you have authority to bind them to these terms.

Your use of the services is also subject to our Privacy Policy, which is incorporated into these terms.

1. Changes to the Terms

We may change or modify these Terms of Service from time to time. When we update the terms, we will revise the update date shown on this page. Your continued use of the services after changes are posted means you accept the updated terms.

2. License and Intellectual Property

Subject to these terms, CodeBaker grants you a limited, non-exclusive, non-transferable, non-sublicensable and revocable license to access and use the services for their intended purpose.

All software, designs, interfaces, text, images, logos, trademarks, service marks, content, features and other materials made available through the services are owned by CodeBaker or its licensors and are protected by applicable intellectual property laws. No rights are transferred to you except the limited rights expressly granted in these terms.

3. SMS Program and Opt-in Terms

By submitting the opt-in form, you agree to receive recurring promotional, marketing, operational and related SMS or MMS messages from CodeBaker at the phone number you provide. Consent is not a condition of purchase.

Message frequency varies. Message and data rates may apply. You may reply STOP to unsubscribe and HELP for help where supported. You agree to provide a valid phone number that belongs to you or that you are authorized to use.

Delivery of messages may depend on wireless carriers, messaging providers and device settings. CodeBaker is not responsible for delays, filtering, failed delivery, carrier charges, unavailable networks or limitations imposed by third-party telecommunications providers.

4. Access and Use of the Services

4.1 Registration and account information

Some services may require registration or submission of information. You agree that information you provide will be accurate, current and complete. You are responsible for maintaining the confidentiality of any account credentials and for activity under your account.

4.2 Age restrictions

You may not use the services if you are under 13 years of age. If you are under the age of majority where you live, you may use the services only with the consent and supervision of a parent or legal guardian.

4.3 Subscriptions and purchases

Some CodeBaker services may include paid features, subscriptions or in-app purchases. Subscription terms, trial periods, renewal rules, cancellation options and pricing will be shown at the point of purchase. Payments may be handled by an app store or payment provider, and their rules may also apply.

4.4 Emergency services

The services are not a substitute for a traditional telephone or emergency communication service. Do not rely on the services to contact 911, 112 or any other emergency number. You must maintain separate arrangements for emergency calls.

5. Conditions of Use

You agree not to use the services for unlawful, harmful, abusive, fraudulent, misleading, harassing, defamatory, discriminatory, obscene, malicious, spam, phishing, scraping, security-circumvention or otherwise unauthorized purposes.

You are solely responsible for your use of the services and for any content, calls, messages or information submitted through them. We may monitor, review, suspend, block or terminate access where reasonably necessary to operate the services, enforce these terms, comply with law, prevent misuse or protect users and the public.

6. Fees, Storage and Availability

You are responsible for any charges imposed by your mobile carrier, internet provider, app store, payment provider or other third parties in connection with your use of the services. Where CodeBaker charges fees, you agree to pay them when due under the terms shown for the applicable service.

Except where required by law, CodeBaker is not obligated to store communications, records, files or other information indefinitely. We may modify, suspend or discontinue all or part of the services at any time.

7. Third-Party Services

The services may rely on app stores, payment processors, telecommunications providers, analytics providers, hosting providers, customer support tools and other third-party services. Your use of third-party services may be subject to their own terms and policies. CodeBaker is not responsible for third-party services that we do not control.

8. Indemnification

To the greatest extent allowed by law, you agree to defend, indemnify and hold harmless CodeBaker, its affiliates, officers, directors, employees, contractors, agents, licensors and service providers from claims, damages, liabilities, losses, costs and expenses arising from your misuse of the services, violation of these terms, violation of law, or infringement of third-party rights.

9. Disclaimer of Warranty

The services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, CodeBaker disclaims all warranties, express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that the services will be uninterrupted, timely, secure, error-free, accurate, reliable or meet your expectations.

10. Limitation of Liability

To the maximum extent permitted by law, CodeBaker will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, loss of profits, loss of goodwill, loss of data or other intangible losses arising from or related to the services.

Where liability cannot be excluded, CodeBaker's total liability will be limited to the amount you paid to CodeBaker for the applicable service in the six months before the claim, or one hundred U.S. dollars, whichever is greater.

11. Dispute Resolution and Class Action Waiver

Please contact us first so we can try to resolve any concern in good faith. To the extent permitted by applicable law, you agree not to participate in any consolidated, class or representative proceeding arising out of these terms or the services.

In case of dispute, Istanbul Anadolu Courts are authorized and Turkish law applies.

12. Severability, Termination and Assignment

If any part of these terms is held invalid or unenforceable, the remaining provisions will remain in effect. We may suspend or terminate your access to the services at any time if we believe you violated these terms, misused the services, created legal risk, or caused harm to CodeBaker, users or third parties.

You may not assign these terms without our written consent. CodeBaker may assign, transfer or delegate these terms or related rights and obligations as permitted by law.
